تعریف بیمه بیکاری عبار ت است از عدم اشتغال فرد که خود فرد دخیل در مورد بیکاریش نشده یا به عبارتی دیگر از ید استیلا کارگر یا کارمند خارج است.بیکار از نظر قانون بیمه بیکاری بیمه شده ای است که بدون میل و اراده خود بیکار شده و آماده به کار باشد. براساس این قانون، چنانچه بیمه شده ای به علت تغییرات ساختار اقتصادی کارگاه مربوطه و به تشخیص وزارتخانه ذیربط و تائید شورای عالی کار ، بیکارموقت شناخته شود و همچنین بیمه شدگانی که به علت حوادث غیرمترقبه مانند سیل ، زلزله ، جنگ ، آتش سوزی بیکار شوند، میتوانند از مقررات این قانون استفاده نمایند .تشخیص ارادی بودن یا غیرارادی بودن بیکاری بیمه شده ، برعهده کمیته ای متشکل از نمایندگان این سازمان و اداره کار و امور اجتماعی محل اشتغال بیمه شده است .واقعیت این است که بیمه بیکاری به عنوان یک ابزار کاربردی در شرایط خاص در قانون کار گنجانده شده است .بوسیله این ابزار کارگران می توانند در دوره بیمه ای خود کمتر متوجه بحران بیکاری شده و فرصتی جهت جستجو برای کار دیگر یابند.
