اصطلاح مالکیت معنوی معادل Intellectual Property در زبان انگلیسی است.
واژه Property در زبان انگلیسی هم به معنای «حق مالکیت» به کار می رود و هم به معنای «مال» و «شیء» که مالکیت به آن تعلق می گیرد. کلمه Intellectual معنای وصفی دارد و بر توانایی فرد به فکر کردن در یک روش عقلایی و شناخت اشیا یا به کارگیری این توانایی دلالت دارد.
تاکنون از مالکیت معنوی تعاریف متعددی صورت گرفته است که ناشی از تنوع مصادیق و تفاوت مبانی حقوقی آن است. اما در یک تصویر کلی می توان گفت: «مالکیت معنوی عبارت است از داشتن و برخوردار بودن از اشیای غیر قابل لمس و حسی که نتیجه تلاش فکری، اعتبار ناشی از عملکرد صادقانه و... انسان است».
در تعریفی دیگر، مالکیت معنوی به حق و حقوقی ابلاغ می شود که یک اثر خلاقانه، یک نوآوری و یک اعتبار کسب و کار را حفظ می کند.
